Mark A. Flagel, Esq.

Mark Flagel spent nearly two decades as a partner at Latham & Watkins LLP, where he was considered a pioneer in patent litigation. He helped grow the firm’s Global Intellectual Property Practice Group into an international team of more than 100 lawyers and served for a number of years as its Co-Chair. Mr. Flagel has been a perennial choice as a Top California IP Lawyer by publications including Best Lawyers, SuperLawyers, Chambers, the Daily Journal, and the Los Angeles Business Journal. Mr. Flagel’s colleagues and clients have lauded his intelligence, enthusiasm, wisdom and insight as well as his humble, low-key approach—qualities that will continue to serve him well as a neutral.

CONFLICT RESOLUTION EXPERIENCE

In addition to having co-chaired the global IP practice at Latham, Mr. Flagel served as global co-chair of the firm’s Information-Technology—Hardware, Software & Services Industry Group, local Litigation Department Chair and a member of the Associates and Recruiting committees. While he successfully handled many high-profile cases through trial including, for example, O2 Micro Inc. v. Monolithic Power Systems Inc., in which he led a trial team that secured an invalidity jury verdict named one of the Top Ten Defense Verdicts of 2007 by the Daily Journal, he was more often successful in avoiding trial altogether through negotiated resolutions frequently involving the use of mediators.

Prior to joining Latham in 1996, Mr. Flagel was a partner at Irell & Manella. During 9 years at Irell, he handled high tech IP litigation focused primarily on patent matters. He was a member of the trial team representing Stac Electronics in the well-known Stac Electronics v. Microsoft case which resulted in a $120 million patent infringement verdict against Microsoft,  followed shortly thereafter by a negotiated resolution. From 1984-1986, Mr. Flagel was an associate at Reboul MacMurray Hewitt Maynard & Kristol, where he assisted in representing the LA Olympic ­Organizing Committee and handled trademark infringement/anti-counterfeiting work for the 1984 Olympics. From 1983-84, he was an associate at Munger Tolles & Rickershauser (now Munger Tolles & Olson).
