Expertise in at least two separate areas of the law are ideal when selecting a neutral for a legal malpractice case. Clearly, experience in handling attorney malpractice cases are a must but additional expertise in the law for the underlying claim is necessary as well.
Private dispute resolution of an attorney malpractice case makes perfect sense. The parties can select an ARC neutral who has expertise in both. If necessary, a neutral that also has insurance coverage expertise can be selected. These cases are somewhat unique because an insurance company cannot settle without the consent of the attorney defendant. Of course, because all attorneys are concerned with maintaining a good reputation, taking the case out of the public arena is desirable.
